General Terms
These general terms and conditions of sale apply to purchases made on the Cinquième - La Maison du Vin website Cinquième.ch (hereinafter Cinquième.ch), or website, https://Cinquième.ch/ (hereinafter website ).
The offers and prices of products made available online are valid only while they are visible on the website and within the limits of available stocks. The images presented on the website are merely illustrative and do not form part of the contractual conditions.
The information and explanations that appear on the website are provided for information only and do not constitute contractual information.
Cinquième.ch declines any responsibility for any errors or omissions related to its information or explanations.
Prices
The prices indicated on the website are exclusively in Swiss francs. Unless stated otherwise, they include all taxes and are stated per bottle or per box. They do not include shipping costs which will be billed separately (see delivery conditions below).
All orders are paid exclusively in Swiss francs.
Cinquième.ch reserves the right to modify its prices at any time. The prices invoiced to the customer for the products delivered are those in effect on the date of the order and which appear in the order confirmation.
Furthermore, promotional discounts offered within the framework of specific commercial actions cannot be combined with other discounts. These special promotional discounts are displayed directly online and displayed prior to order confirmation.
Order
In Switzerland, the purchase of alcohol is prohibited for persons under 18 years of age. The customer confirms, when placing the order, that they or the recipient of the products are at least 18 years old, and guarantees that all information transmitted is adapted to reality.
The order is considered placed as soon as the customer validates their transaction on the website. Sending the order to the customer implies acceptance of these general conditions of sale in their entirety, excluding any other terms or conditions.
Cinquième.ch reserves the right to refuse any request from a customer.
When a vintage is sold out, we deliver the next available vintage without prior notification. This is applicable as long as the new vintage is comparable in terms of price, quality and variety. For top of the range wines, we will ask for your permission before delivering a different vintage.
Payment
The invoiced price is the value indicated in the order confirmation that is sent to the customer.
We offer the following payment methods:
- Credit cards (free of charge), with Shopify Payments, through our secure website;
- Bank transfer (free of charge). Goods will be shipped as soon as the amount due is credited to the bank account of Cinquième.
- Payment in store (free of charge). This method of payment is available for orders for which the "collection of goods" delivery method at the Cinquième facilities has been chosen.
Private tastings and dinner nights
1. Private tastings are booked through the form on our website or by email.
1.1. The reservation is confirmed by replying to the e-mail and upon payment of the reservation.
1.2. Cancellation of participation by the customer:
- The customer can cancel or reschedule their private tasting free of charge up to two weeks before the tasting date.
- For any cancellation between 7 days and 24 hours before the private tasting, the customer will only be entitled to a refund of 50% of the registration fee.
- Any cancellation less than 24 hours before the start of the private tasting will not entitle the customer to any refund or postponement.
- Any cancellation request must be sent to Cinquième by email.
2. Dinner nights are an event created by Cinquième in partnership with a restaurant.
2.1. Cancellation of participation by the customer:
- The customer can cancel his reservation free of charge up to one week before the test date.
- For any cancellation between 7 days and 24 hours before the dinner night, the customer will only be entitled to a refund of 50% of the registration fee.
- Any cancellation less than 24 hours before the start of the dinner night will not entitle you to any refund or postponement.
- Any booking cancellation request must be sent to us by email or telephone.
2.2. In case of low attendance, Cinquième reserves the right to postpone or cancel the dinner night. The customer will have the option of accepting the date change or requesting a refund.
Delivery conditions
General Terms
The products are delivered to the delivery address indicated by the customer when placing the order. The latter is responsible for providing Cinquième.ch with a complete and accurate delivery address.
In the event that delivery cannot be carried out as agreed due to the fault of the customer, the costs of return and second delivery will be invoiced at cost price.
Delivery takes place as soon as the product is made available to the customer by the carrier or at the place agreed with the customer. As a rule, delivery will be made at the door of the customer's address.
Delivery Times
As a rule, our items are in stock and are delivered on working days, within 2 to 5 working days.
All items that are not in stock are delivered according to their availability within 10 to 15 working days.
If an item cannot be delivered after 30 days, the order is automatically canceled and the customer is notified by email. In case of abnormal delay, Cinquième.ch informs the customer by email.
The delivery times indicated by Cinquième.ch are given as an indication. Some remote areas in Switzerland may require a few extra days for delivery. Cinquième.ch and its partners strive to respect them. However, exceeding delivery times may not result in the cancellation of the order by the customer, nor in compensation or fines for late payment.
Delivery fees
We carry out home wine deliveries throughout Switzerland at a fixed rate, regardless of distance. Our logistics partners guarantee fast and reliable delivery. Delivery costs will be invoiced to the customer as follows:

Returns and Complaints
It is the customer's responsibility to check the goods immediately after delivery and make any reservations and claims for any defects or non-compliance. These reservations and complaints must be sent to Cinquième.ch by email (info@cinquieme.ch) as soon as possible, but no later than 3 days after delivery.
Shipping costs, in case of returning goods, are the responsibility of the customer.
Our products have glass packaging, which requires them to be well stored, preferably horizontally, to maintain the quality of the wine, so returns are accepted under the following conditions:

If the label is damaged in any way, you can return the bottle as long as you haven't opened it.

When, upon opening the bottle, there is a problem with the quality or smell of the wine that is not directly related to the typology and characteristics of the specific wine (for example, if it smells like vinegar, smells like cork or any other alteration not characteristic of the wine);

If the glass in the bottle arrives chipped or damaged in any way.
Warranty
Cinquième.ch grants a 12-month guarantee on any defects in the wine (in particular, cork taste), as long as it has been stored in suitable conditions for its good conservation.
This guarantee is not valid for wines older than 5 years or for grand crus.
In order for Cinquième to replace the faulty wine, the customer must inform the customer in advance by email (info@cinquieme.ch). Upon agreement with Cinquième.ch, the customer will return the defective wine in its original packaging with a copy of the invoice. Shipping costs are paid by the customer.
Cash refunds are excluded. The customer will receive a voucher for the value of the defective wine to use on the website.
